Bankruptcy is a long recognized form of legal debt relief for regular people. The Federal Government recognized that some people just get in over their heads and they cannot get out of debt no matter how much of their salary they pay. They may even have started a business which never took off and ended in mountains of debt. Bankruptcy covers a large spectrum of solutions which are separated by chapters. While there are many Chapters for bankruptcy, the two most common for consumers is Chapter 7 and Chapter 13 bankruptcy. A Chapter 7 bankruptcy is meant to be a liquidation of assets and a total discharge of unsecured debt. That means the Federal Bankruptcy Court will discharge (or get eliminated) all of a person's unsecured debt (such as credit cards, medical bills, judgments, back rent, repossessions, personal loans, and even some taxes) after the court processes the paperwork. In return the person agrees to liquidate assets that have some value (although the person will be allowed to keep some items such as clothes, car, and some amount of personal effects/savings).
In a Chapter 13, the person in debt agrees to repay a portion of the debt they owe over a 3 or 5 year payment plan with the government. The Bankruptcy Trustee will collect a monthly payment from the person and pay all the creditors over the course of time. The amount or percentage of payback is based on what the person earns. There is no negotiation with each individual creditor as the government just sets a pay back percentage. The Chapter 13 bankruptcy will allow a person to keep their house and/or cars.
