I had a client come to my Beaverton, Oregon office the other day for a bankruptcy consult. All was going well and it was looking like a Chapter 7 filing was in his future.  It was a pretty standard tale of credit card debt, medical bills and some creditor harassment.  The one interesting aspect that gives rise to this bankruptcy blog post is that he owned 3 rental condo's with HOA dues of around 300.00 per month each.  He was concerned on whether he should pay these or can he stop paying on these like his credit card bills and will it be discharged upon successful completion of his Chapter 7 bankruptcy filing.
 
This is a topic that is very State specific but here in Oregon it ends up being fairly straight forward.  Basically if you are going to give back the condo's or homes to the bank then the HOA fees that were due prior to the bankruptcy filing are discharged. However any HOA fees that come due post filing remain the owners responsibility until the house ownership actually transfers to the bank or subsequent owner as part of the foreclosure process. The problem is the foreclosure can take a great deal of time and the HOA dues continue to mount.
